These Terms and Conditions apply to all products and services sold through cherylmalanek.com and any related checkout pages, including self-study courses, coached programmes, memberships, subscriptions, workshops and digital resources.
By purchasing any product or service from us, you confirm that you have read, understood and agreed to these Terms and Conditions.
These Terms apply without prejudice to any mandatory consumer rights you may have under Spanish and European Union consumer law.
A separate Aviso Legal is available on our website and contains the full legal identification details of the business owner.
We currently offer the following products and services:
a) Self-study digital courses
Self-study B2
Self-study C1
These products include immediate access to pre-recorded training videos and course materials on our online platform. They also include access to a Telegram support community for one year from the date of purchase.
Unless otherwise stated on the sales page, access to the training materials is lifetime access. “Lifetime access” means access for as long as the course remains available on our platform. It does not mean the lifetime of the purchaser.
b) Cambridge Advanced Accelerator
The Cambridge Advanced Accelerator is a coached exam preparation programme. It may be offered in different fixed-term options, including but not limited to:
10-week option
12-week option
20-week option
24-week option
The exact features, duration, price, official start date and payment terms for each option will be shown on the relevant sales page or checkout page at the time of purchase.
Depending on the option purchased, the programme may include access to pre-recorded training materials, live speaking sessions, writing feedback, study plans, Telegram support, live workshops, mock exam guidance and other forms of support.
Students do not receive access to the Accelerator platform, Telegram group, live classes, study plan, onboarding or support until the official course start date, unless we expressly agree otherwise in writing.
c) Diamond Accelerator
The Diamond Accelerator includes the same core training and support as the relevant Accelerator programme, plus additional individual support.
Diamond options may include:
3-month option
6-month option
1:1 DM access to Cheryl
1:1 Zoom check-ins every 6 weeks
Additional personalised support, as described on the relevant sales page or checkout page
The exact features, duration, price, official start date and payment terms will be shown at the time of purchase.
Students do not receive access to the Diamond Accelerator platform, Telegram group, live classes, study plan, onboarding, DM support, Zoom check-ins or other support until the official course start date, unless we expressly agree otherwise in writing.
d) Monthly continuation subscription
After completing an eligible fixed-term Accelerator programme, students may be offered the option to continue on a monthly subscription.
The exact features and price of the monthly continuation subscription will be shown at the time of purchase.
Monthly subscriptions can be cancelled before the next billing date. Cancellation stops future payments but does not create a refund for previous payments already made.
Our courses are designed for adult learners of English. Some courses are designed for specific levels, such as B2, C1 or Cambridge Advanced preparation.
It is your responsibility to make sure that the course you purchase is suitable for your current level, goals and availability. If you are unsure, you should contact us before purchasing.
We reserve the right to refuse enrolment or recommend a different option if we believe a course is not suitable for your current level or needs.
For self-study courses, access to the digital course platform is normally granted immediately after payment, unless otherwise stated.
For coached programmes, including the Cambridge Advanced Accelerator and Diamond Accelerator, access begins on the official course start date, unless otherwise agreed in writing.
You are responsible for making sure that you have a suitable internet connection and device to access the course materials.
You must not share your login details with anyone else. Access is for your personal use only.
We reserve the right to suspend or remove access without refund if we believe that login details, course materials, videos, PDFs, recordings or resources have been shared, copied, reproduced, distributed or misused.
Where a product includes “lifetime access”, this means access for as long as the course remains available on our platform.
We may update, replace, remove or reorganise course content from time to time.
If we decide to permanently close a self-study course or remove it from the platform, we will aim to give reasonable notice where possible.
Some products include access to a Telegram community.
For Self-study B2 and Self-study C1, Telegram community access is included for one year from the date of purchase, unless otherwise stated.
For coached programmes, Telegram access is included during the active period of the programme, unless otherwise stated.
Telegram support is designed to offer guidance, encouragement and general course-related help. It does not guarantee immediate replies, unlimited personal coaching or emergency support.
We may remove students from the Telegram community if they breach these Terms, behave disrespectfully, share inappropriate content or misuse the group.
Some coached programmes include live speaking sessions, group calls, workshops, 1:1 Zoom check-ins, written feedback, study plans, DM support or other forms of individual or group support.
Live sessions may be affected by holidays, public holidays, illness, technical issues, low attendance or other circumstances outside our control.
We reserve the right to make reasonable changes to the timetable, class format, teachers, support structure or delivery method, provided that the overall value and purpose of the programme are not materially reduced.
If a student cannot attend a live class, call or workshop, this does not create a right to a refund, partial refund or replacement session unless this has been expressly agreed in writing.
Where writing feedback is included, students must submit work according to the instructions given inside the course or community.
We may refuse to mark work that is incomplete, not connected to the relevant exam task, submitted in the wrong format, sent through the wrong channel or submitted in a way that creates unreasonable administrative work.
Unless otherwise stated, writing feedback and study plans are provided during the active period of the relevant programme only.
Unused writing feedback, calls, study plans, live sessions or support cannot be transferred, rolled over, exchanged for money or used after the end of the programme unless we agree otherwise in writing.
Diamond students may receive 1:1 DM access to Cheryl and 1:1 Zoom check-ins every 6 weeks, as described on the relevant sales page.
DM support is designed for reasonable course-related guidance, accountability and questions. It is not an unlimited 24-hour support service.
Unless otherwise stated, DM support is available during normal working hours, Monday to Friday, excluding holidays, public holidays and periods of leave.
We reserve the right to set reasonable boundaries around the volume, frequency and nature of DM support.
Depending on the product, we may offer one or more of the following payment options:
Pay in full
Split payment plan
Monthly subscription
The exact price, payment schedule and billing terms will be shown at checkout before purchase.
If you choose to pay in full, you pay the full course fee at the time of purchase.
If you choose a split payment plan for a fixed-term course, you are agreeing to pay the full course fee in instalments.
A split payment plan is not a monthly subscription and it is not a pay-as-you-go arrangement. It is a fixed payment plan for the full course fee, divided into instalments for convenience.
By choosing a split payment plan, you agree to complete all instalment payments according to the payment schedule shown at checkout.
Failure to complete instalment payments may result in suspension of access to the course, live classes, feedback, Telegram support, bonuses and any other services connected to the programme.
We reserve the right to recover unpaid amounts through appropriate legal or debt recovery channels where necessary.
Monthly subscriptions are billed monthly until cancelled.
You may cancel a monthly subscription before your next billing date. Cancellation stops future billing but does not create a refund for payments already made.
If you cancel after a payment has been taken, you will normally keep access until the end of the billing period, unless otherwise stated.
If you are purchasing as a consumer online, you may have a legal right to withdraw from the contract within 14 calendar days without giving a reason, unless a legal exception applies.
For services, the withdrawal period normally begins on the date of purchase, which is the date the contract is concluded.
To exercise the right of withdrawal, you must inform us clearly before the withdrawal period has expired.
You can do this by emailing info@cherylmalanek.com or by using the withdrawal request form available on our website.
Submitting a withdrawal request does not automatically guarantee a refund. Withdrawal requests and refunds are assessed according to these Terms and applicable consumer law.
You may use the model withdrawal form included at the end of these Terms, but you are not required to use that specific form.
Self-study B2 and Self-study C1 are digital products with immediate access to the online platform, training videos, PDFs, worksheets, resources and Telegram support community.
Because these products include digital content that is not supplied on a physical medium, you may lose your right of withdrawal once access to the digital content begins, provided you have given your express consent to immediate access and acknowledged that you will lose your right of withdrawal once access begins.
This means that, where you have given the required consent and acknowledgement at checkout, refunds cannot be offered once access to the self-study course has begun.
Access may include, but is not limited to:
logging into the course platform
watching video lessons
accessing or downloading PDFs, worksheets or course materials
accessing course resources or recordings
joining the Telegram community
using any part of the course content or support
If you purchase a self-study course but do not access the digital content, you may request withdrawal within 14 calendar days of purchase, unless another legal exception applies.
This section applies to fixed-term coached programmes, including the Cambridge Advanced Accelerator and Diamond Accelerator.
For coached programmes, your 14-day withdrawal period begins on the date of purchase, not on the official course start date.
Students do not receive access to the platform, Telegram group, live classes, study plan, onboarding, DM support, Zoom check-ins or other support until the official course start date, unless we expressly agree otherwise in writing.
If you purchase a coached programme before the official course start date, and you request withdrawal within 14 calendar days of purchase, you may receive a full refund provided that:
the course has not yet started
you have not received access to the platform
you have not joined the Telegram community
you have not attended any live class, call, workshop or session
you have not received onboarding
you have not received a personalised study plan
you have not received writing feedback, DM support, Zoom check-ins or other personalised support
you have not otherwise started using the programme
If the official start date of the coached programme falls within 14 calendar days of your purchase, the programme may begin during your withdrawal period.
At checkout, you may be asked to confirm that you understand the course start date and that you agree for the programme to begin during the withdrawal period.
Once the programme has started, this may include access to the online course platform, training videos, PDFs, worksheets, resources, live classes, Telegram support, welcome meeting, onboarding, personalised study planning, writing feedback, DM support, Zoom check-ins or other forms of support included in your programme.
If you withdraw during the 14-day period after the programme has started, any refund due may be reduced to reflect the digital access and services already provided up to the date you notify us of your withdrawal.
For this purpose, “access and services already provided” may include, but are not limited to:
access to the online course platform
access to training videos, PDFs, worksheets, resources and recordings
access to the Telegram community or support channels
availability of live speaking sessions or live classes
attendance at any live session, class, workshop or call
a welcome meeting or onboarding support
creation of a personalised study plan
writing feedback, mock feedback or other personalised feedback
1:1 DM support
1:1 Zoom check-ins
administrative onboarding and account setup
Because coached programmes are hybrid programmes, the digital content, live teaching, community support, personalised study planning, feedback and coaching are designed to work together and are not sold as separate standalone products.
Any refund calculation will be based on the overall programme access and services already made available or delivered.
After the 14-day withdrawal period has expired, fixed-term coached programmes are non-refundable.
This applies whether you have chosen to pay in full or by split payment plan.
Not attending classes, not using the platform, changing your mind, being too busy, deciding not to take the exam, finding the course too difficult or choosing to stop participating does not create a right to a refund or cancellation of remaining instalments.
In exceptional circumstances, such as serious illness or major personal emergency, we may choose to pause access or offer an alternative arrangement at our discretion. This is not guaranteed and will be considered case by case.
Where a course pause or freeze is offered, the conditions will be explained in the relevant course information.
A pause or freeze does not cancel your payment obligations unless we agree this in writing.
For split payment plans, instalments normally continue during a pause or freeze.
We are committed to providing high-quality training, guidance and support. However, we cannot guarantee that you will pass an exam, achieve a particular score, improve by a specific amount or reach a specific level by a specific date.
Your results depend on many factors, including your starting level, consistency, attendance, study habits, effort, personal circumstances and exam performance.
Testimonials, student results and examples are not guarantees of your individual outcome.
We expect all students to behave respectfully towards teachers, staff and other students.
We have zero tolerance for:
racism
sexism
homophobia
transphobia
discrimination
bullying
harassment
abusive language
threatening behaviour
sharing private student information
disruptive behaviour
misuse of the community or platform
We reserve the right to remove a student from the course, platform, live classes or community without refund if they breach these standards.
All course materials, videos, PDFs, worksheets, recordings, slides, templates, resources, written feedback, study plans and training materials are owned by Cheryl Malanek or licensed to us.
You may use the materials for your own personal study only.
You must not copy, reproduce, sell, share, upload, distribute, teach from, adapt or otherwise use our materials for commercial or public purposes without written permission.
This includes sharing materials with friends, colleagues, students, schools, academies, teachers, Telegram groups, WhatsApp groups, AI tools, public websites or social media platforms.
Some live sessions may be recorded for training, replay or course purposes.
If a session is recorded, we will let students know where appropriate. By attending live sessions, you understand that your voice, image, name or contributions may appear in the recording.
You must not record live sessions yourself unless you have our written permission.
We may suspend or terminate your access if:
you fail to make payments when due
you share login details or course materials
you breach student conduct rules
you misuse the platform or community
you infringe our intellectual property
you behave in a way that makes it unreasonable for us to continue providing services to you
Suspension or termination for breach of these Terms does not automatically cancel your payment obligations or create a right to a refund.
We make reasonable efforts to keep the platform and course materials available. However, we cannot guarantee uninterrupted access.
Temporary technical issues, maintenance, updates or platform outages do not create a right to a refund unless they materially prevent access for an unreasonable period and we are unable to provide a reasonable alternative.
We may update or improve course content, resources, class formats, timetables, teachers, support channels or delivery methods from time to time.
We will not make changes that materially reduce the core value of a product or service you have already purchased without a reasonable alternative.
We process personal data according to our Privacy Policy.
By purchasing a product or service, you agree that we may process your personal data for purposes including course access, payment processing, communication, support, legal compliance and service delivery.

If you have a complaint, please contact us first at info@cherylmalanek.com so we can try to resolve the issue directly.
Please include your name, the product purchased, the date of purchase and a clear explanation of the issue.
These Terms are governed by the laws of Spain.
If you are a consumer, this does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.
Any disputes will be handled by the courts or authorities that are legally competent under applicable consumer protection rules.
We may update these Terms from time to time.
The Terms that apply to your purchase are the Terms in force at the time of purchase, unless a change is required by law or you expressly agree to updated Terms.
