These Terms and Conditions (“Terms”) apply to all products and services offered through cherylmalanek.com, including The Cambridge Advanced Accelerator and Break Through B2. Please read them carefully before enrolling in any course. By purchasing a course, you agree to the Terms outlined below.
SECTION A: The Cambridge Advanced Accelerator
1. Introduction
These Terms govern your access to and use of The Cambridge Advanced Accelerator (“the Course”), provided by Cheryl Malanek (“we”, “us”, or “our”).
2. Course Tiers and Services
We offer three membership tiers:

Weekly live speaking sessions (minimum 8 hours per week, excluding national holidays)

Diamond Membership

Unlimited writing feedback

Monthly one-on-one check-in
We reserve the right to modify the features in each tier, with notice provided to members.
3. Payment and Membership Plans
We offer two payment options:
1. Pay in Full:
You pay the full course fee upfront.
2. Payment Plan (Split Pay):
You agree to pay the full course fee in fixed monthly installments. This is not a subscription — it is a payment plan for the full course cost, divided for convenience.
By choosing a payment plan, you are legally committing to complete all agreed payments. Failure to do so may result in:

Suspension of access to course materials, feedback, and support

Withdrawal of bonuses

Referral to a collections agency or legal action if necessary
Refund Policy:

No refunds are offered for any course purchases

In exceptional circumstances (e.g. serious illness), we may pause your membership at our discretion
4. Cancellation Policy
Cancellations are not permitted. This is a fixed-term program. Whether you pay in full or in installments, you are committing to the full course.
If you are unsure about your ability to complete payments, we recommend waiting until you are ready to commit.
5. Upgrades and Add-Ons

6. User Conduct
Respectful participation is expected. We have zero tolerance for:

Racism, sexism, homophobia, or discrimination

Abusive or disruptive behavior
Violations may result in removal without refund.
7. Access to Course Materials
You may download PDFs and resources for personal use only. Sharing, distributing, or reproducing materials outside the course is prohibited.
8. Intellectual Property
All course content is protected by copyright. You may not reproduce or redistribute any materials without written permission.
9. Privacy Policy
Your personal data is collected and used according to our Privacy Policy. By enrolling, you agree to its terms.
10. Disclaimer of Warranties
We do not guarantee any specific results. Success depends on your effort and participation.
11. Limitation of Liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages from your use of the Course.
12. Governing Law
These Terms are governed by the laws of Spain. Disputes will be handled in the courts of Tenerife, Canary Islands.
SECTION B: Break Through B2
1. Introduction
These Terms govern your purchase and use of Break Through B2, a self-study course provided by Cheryl Malanek.
2. Course Access
Upon purchase, you will receive lifetime access to the course materials via our online platform. “Lifetime” refers to the life of the course on our platform, not your lifetime.
3. Payment Terms
Break Through B2 is sold as a one-time payment of €99. Access is granted immediately after payment.
4. Refund Policy
Due to the digital nature of the course and immediate access to all content, no refunds will be offered under any circumstances.
5. Intellectual Property
All course content is our intellectual property and may not be copied, shared, or distributed outside of personal use.
6. User Conduct
You agree not to misuse or share course materials or access with others.
7. Disclaimer
This is a self-study course. It does not include live classes or personalised feedback. Results are not guaranteed and depend on your own effort.
8. Limitation of Liability
We are not liable for any indirect or consequential damages related to your participation in the course.
